These Terms & Conditions (“Terms”) apply to your use of the Brandwirk website and to the services provided by Brandwirk (“we”, “us”, “our”). By using this website or engaging our services, you agree to these Terms.
1. Our services
We provide digital marketing, design and development services, including SEO, paid advertising, social media, content, email marketing, branding, graphic design, video, copywriting, websites, mobile apps and software. The exact scope of any project is set out in a written proposal, quote or agreement (“Proposal”).
2. Proposals and agreements
A project begins when you accept a Proposal in writing or pay the first invoice. If a Proposal and these Terms conflict, the Proposal takes priority. Work outside the agreed scope will be quoted separately before it starts.
3. Pricing and payment
- Prices shown on our pricing page are a guide. The price for your project is the one stated in your Proposal.
- Invoices are payable by the date shown on the invoice. Work may be paused if payment is overdue.
- Third-party costs such as advertising spend, hosting, domains, licensed assets and software subscriptions are not included unless your Proposal says so.
- Applicable taxes are added where required by law.
4. Your responsibilities
To deliver on time, we rely on you to provide accurate information, content, access and feedback when requested, and to make sure you have the right to use any materials you supply to us. Delays in providing these may affect delivery dates.
5. Revisions and approval
Each service includes the revisions stated in your package or Proposal. Further changes, or changes requested after you have approved a deliverable, may be charged separately.
6. Intellectual property
- Once you have paid in full, you own the final deliverables created specifically for you.
- We keep ownership of our pre-existing tools, methods, templates and know-how, and grant you the right to use them as part of the deliverables.
- Third-party items such as fonts, stock images, plugins and software remain subject to their own licenses.
- Unless you ask us not to, we may show the finished work in our portfolio and marketing.
7. Third-party services
Some services depend on platforms we do not control, such as search engines, advertising networks, social media platforms, app stores and hosting providers. We are not responsible for changes, outages or decisions made by those platforms.
8. Results
We work to professional standards and aim for the best possible outcome. Because results in areas such as search rankings, advertising performance and social media growth depend on factors outside our control, we do not guarantee specific results.
9. Confidentiality
Each party agrees to keep the other’s confidential information private and to use it only for the purpose of the project, unless disclosure is required by law.
10. Use of this website
You may use this website for lawful purposes only. You must not attempt to disrupt it, gain unauthorized access to it or copy its content for commercial use without our permission. All content on this website belongs to Brandwirk or its licensors.
11. Disclaimer
This website and its content are provided “as is”. To the fullest extent permitted by law, we make no warranties about the accuracy, completeness or availability of the website.
12. Limitation of liability
To the fullest extent permitted by law, Brandwirk is not liable for indirect or consequential losses, or for loss of profits, revenue or data. Our total liability for any claim relating to a project is limited to the amount you paid us for that project.
13. Termination
Either party may end a project by giving written notice as set out in the Proposal. You agree to pay for work completed and costs committed up to the date of termination.
14. Privacy
Our Privacy Policy explains how we collect and use personal information.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which Brandwirk is established, and any dispute will be handled by the courts of that jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page shows when they were last revised.
